Protection of Privacy
(Informative note compliant and pursuant to art. 13 of the Legislative Decree dated 30th June 2003, n. 196.)

We hereby inform you that the Leg. Decree no. 196 of the 30th of June 2003 ("Code governing matters regarding the protection of personal data") foresees the protection of people and other subjects with regard to the processing of their personal data. According to the above code, the processing involved will be performed according to principles of correctness, lawfulness and transparency and protection of your confidentiality and your rights. 


Pursuant to art. 13 of the Leg. Decree no. 196/2003, we therefore provide you with the following information:

 1. All the data communicated by the subjects involved is processed exclusively in order to carry out procedures connected to the company's economic activity and in particular: 
- to include said data in the company's computer based client databases;
- for the production of internal statistics; 
- to draft technical reports concerning the services requested by clients and/or potential clients; 
- to issue shipping documents, invoices, credit notes; 
- to issue estimates and offers to active and/or potential clients; 
- to prepare offer requests to active and/or potential suppliers;
- in order to keep ordinary and VAT accounts; 
- to manage incoming and outgoing payments; 
- to send commercial information regarding the company's activity or those of company's connected to active and/or potential clients; 
- in order to comply with legal requirements, regulations, European community regulations, civil and tax legislation.

For the purposes of the processing involved, the data controller may become privy to so called "sensitive" data as defined by Leg. Decree no. 196/2003, such as those apt to reveal racial or ethnic origin, religious convictions, political opinions, membership of political parties, trade unions, associations or organizations of a religious nature, the state of health and details of the person's sex life.

 2. The processing will be carried out using both manual and automated systems designed to memorize, manage and transmit the data itself, according to criteria strictly connected the purposes of the data collection, on the basis of the data in our possession and with the undertaking on your part to promptly communicate any corrections, integrations and/or necessary updates concerning said information.

 3. Within the scope of the described processing we must acquire knowledge and memorize information relative to personal data, tax code, VAT number, accounting data. Failure to provide said data, or the forwarding of incorrect data, can lead to the following consequences: 

- the impossibility for the controller of the process to guarantee the consistency of the processing itself with the contractually based agreement on the basis of which said processing has been undertaken; 
- the possible discrepancy between the results of the processing itself and the obligations imposed by tax, administrative or labour regulations that are the purpose of the processing. 
The transfer of one's personal data, on behalf of the subjects that intend to set up a commercial relationship with our company, even if purely in order to acquire information on our activities/services, is to be considered optional, but failure to provide them may hinder the continuation of the relationship, its correct performance and compliance with legal or tax requirements. The data is held at our company's operational headquarters, for the time prescribed by civil and tax regulations.

 4. Your sensitive data may be communicated in order to allow fulfilment of contractual or legal obligations: 

- to all subjects whose right to access to this data is acknowledged on the basis of regulatory procedures; 
- to our collaborators, employees, agents and suppliers in the performance of their duties and/or any contractual obligations with them, relating to the commercial relations with the subjects in question; 
- factoring, credit recovery companies, credit insurance companies; - to post offices, shipping companies and couriers for the shipping of documentation and/or material; 
- to all those physical and/or legally established subjects, either public or private (legal, administrative and tax consultancy firms, labour consultancy firms for the drafting of payrolls, Judicial Offices, Chamber's of Commerce, Labour Chambers and Offices, etc.), when their communication to these subjects is either necessary or functional to the performance of our activity and according to the methods and for the purposes detailed above; 
- banking institutes for management of income and payments relative to the performance of the contracts; 
- to external consultants for the sole purpose of complying with tax or legal obligations.
Your sensitive data may be communicated in order to allow fulfilment of contractual or legal obligations:
- to Public or Private Institutions, even following inspections or verifications (such as the Tax and Excise offices, Tax Police bodies, Judicial authorities, the Labour Inspectorate officers, Primary Health Authorities, Social Security Institutions, ESA/SARCO, Chambers of Commerce, the Institute for on-job injuries, Customs Authorities) for the sole purpose of fulfilling the tasks entrusted to us.

 5. The controller of the process is the legal representative of the Reca Group SpA company.

 6. The person responsible for the processing is the legal representative of the Reca Group SpA company. 

 7. At any time you may exercise your rights towards the processing controller, pursuant to art. 7 of the Leg. Decree no. 196/2003 which for your convenience we here reproduce in full: 

"1. The interested party has the right to obtain confirmation of the existence of any personal data concerning him or her, even if not yet recorded, and their communication in an intelligible form. 2. The interested party has the right to be informed: a) on the origin of the personal data; b) on the purpose and processing procedure used; c) on the logic applied to any electronic processing procedures; d) on the identity of the organization and person responsible for processing personal data pursuant to article 5, clause 2; e) on the persons or categories of persons to whom the personal data may be communicated or who may become privy to them as designated agents in the territory of the country, their management staff or employees. 3. The interested party also has the right to obtain: a) the updating, rectification or, if in their interest, the integration of the data; b) their removal, transformation into anonymous form or the blocking of the data processed in violation of the law, including those that need not be preserved in order to pursue the purposes for which they were collected or subsequently processed; c) confirmation that the operations reported under letters a) and b) above have been brought to the attention, also as regards their content, of the persons to whom the data has been communicated or distributed, unless compliance with this rule is found to be impossible or would necessitate the use of means clearly disproportionate to the right safeguarded. 4. The interested party has the right to totally or partially oppose: a) the processing of its personal data for legitimate reasons, despite said processing being pertinent to the purpose of their collection; b) the processing of personal data that concern it for the purpose of distributing advertising material or direct sales or for market surveys or trade communications".

By accessing the web catalog, you confirm that you have been informed in advance by the controller of: a) the purpose and processing method to be used on the data; b) The compulsory or optional nature of data conferral; c) the consequences of any refusal to confer said data; d) the subjects or categories of subjects to whom the personal data may be communicated or that may become privy to them as persons responsible or employed in their processing, and the scope of the distribution of the data in questions; e) your rights pursuant to art. 7 of the Leg. Decree no. 196/2003; f) The details of the data controller and person responsible for processing.

You also acknowledge that the existence of any sensitive data among the data collected is clearly indicated and that being fully aware of this, you extend your consent to the processing and communication of said data, within the constraints of all other legally binding conditions.
